Once again, a seemingly unevent-
ful Port of Shelton agenda gave
way to a meeting filled with inter-
ruptions, arguments and drama on
Tuesday afternoon.
In order to discuss commissioner
Jack Miles' formal complaint, which
he lodged against port executive di-
rector John Dobson during the port's
January 4 meeting, the commission
was prepared to enter into an execu-
tive "session at the end of the meet-
ing.
However, questions about who
should be allowed into that closed
section of the meeting, and what
could legally be discussed, delayed
the executive session for about fif-
teen minutes.
The commission quickly decided
that it would be appropriate for Dub-
son's lawyer to be present during
the review of the complaint made
against him.
But when Miles requested that
his attorney also be present, the oth-
er commissioners said no.
"No one's challenging you," com-
missioner Tom Wallitner said.
"You're the one who's made the
charges. I believe that Mr. Dobson is
required or at least entitled to have
his attorney present to answer to
those charges, but I see no reason for
your attorney to be in the room."
Wallitner, however, seconded
Miles' motion to allow his own at-
torney to be present for discussion
purposes.
"Commissioner Wallitner, some
very serious allegations have been
made," Miles said. "Allowing one at-
torney to be present and not another

is not fair to either one of us."
Port attorney Skip Hauser in-
formed the commission that they
had many options including allowing
both lawyers, one lawyer, or neither.
Miles also suggested that it would
be improper for commissioner Jay
Hupp to hear the complaint in an ex-
ecutive session because he had been
subpoenaed to appear in the district
court hearing on the matter.
"The point of the matter is that we
have a sitting commissioner that's
hearing a complaint that's been sub-
poenaed to appear in court tomor-
row," Miles said. "It is improper for
him to hear this complaint ... I need
my attorney for that purpose."
Wallitner said that he has not re-
ceived a subpoena.
"We should deal with that issue
today, and we should do it in an ex-
ecutive session and we should do it
with the attorney present for the
port employee who's going to have to
defend himself," Hupp said.
Dobson said that he agreed with
Hupp, and Wallitner said he agreed
with Dobson.
In the end, the commissioners de-
cided to enter into an executive ses-
sion and only allow Dobson's lawyer
to be present.
A district court hearing on Miles'
allegations against Dobson was set
to take place at 3:30 p.m. Wednesday
afternoon, after this paper's press
deadline.
