pursuant to RCW 61.24.130(4) will on the 25th day

Courthouse, 4th & Alder Street, in the City of Shel-
ton, State of Washington, sell at public auction to
the highest and best bidder, payable at the time of
sale, the following described real property, situated
in the County of Mason, State of Washington, to-

Easement= Subject to a perpetual easement for
the construction, ownership, maintenance, altera-
tion, repair and replacement of surface water drain-
age facilities and any and all other utilities, together
with access for such purposes, as reserved by the
City of Shelton in instrument recorded January 6,
1999 Auditor's File No. 682092. Commonly known
as 1027 Euclid Avenue, Shelton, Mason County,
Washington Tax Parcel No. 32019-59-13007 which
is subject to that certain Deed of Trust dated July
15, 1999, recorded July 23, 1999, under Auditor's
File No. 1594639, records of Mason County, Wash-
ington, from HUMBERTO NICOLAS and KRIS-
TINE E. NICOLAS, husband and wife, as Grantor,
to MASON COUNTY TITLE COMPANY, as Trust-
ee, to secure an obligation in favor of HABITAT
FOR HUMANITY, MASON COUNTY AFFILIATE,
as Beneficiary. Notice of Trustee's Sale was ini-
tially recorded on August 12, 2010 with a sale date
of November 12, 2010. On November 12, 2010
Grantor Kristine E. Nicolas filed Chapter 13 Bank-
ruptcy with the United States Bankruptcy Court
Western District of Washington under cause no.
10-49354-PBS. The November 12, 2010 sale was
postponed until December 3, 2010 due to the
bankruptcy filing and the December 3, 20t0 sale
was postponed until January 7, 2011. Notice of
Dismissal was entered in the Nicolas Chapter 13
bankruptcy matter on December 7, 2010. The sale
outlined in this Notice of Trustee's Sale is being
conducted pursuant to RCW 61.24.130(4). I1. No
action commenced by the beneficiary of the Deed
of Trust is now pending to seek satisfaction of the
obligation in any Court by reason of the Borrower's
or Grantor's default on the obligation secured by
the Deed of Trust. II1. The default for which this fore-
closure is made is as follows: Failure to pay when
due the following amounts which are now in ar-
rears: Total Principal Due in the amount of:
$19,761.01 Delinquent Interest at the rate of 8%
From September 15, 2009 $2,286.86 Property In-
surance paid by Beneficiary $532.00 Late Payment

~um owing on the obligation secured by the Deed
of Trust is: Principal $19,761.01 together with inter-
est as provided in the note or other instrument se-
cured from the 15th day of September, 2010 and
such other costs and fees as are due under the
note or other instrument secured, and as are pro-
vided by statute. V. The above-described real prop-
erty will be sold to satisfy the expense of sale and
the obligation secured by the Deed of Trust as pro-
vided by statute. The sale will be made without
warranty, express or implied, regarding title, pos-
session, or encumbrances on the 12th day of No-
vember, 2010. The default referred to in paragraph
III must be cured by the 1st day of November, 2010,
to cause a discontinuance of the sale. The sale Will
be discontinued and terminated if at any time on or
before the 1st day of November, 2010, the default
as set forth in paragraph III is cured and the Trust-
ee's fees and costs are paid. The sale may be ter-
minated any time after the 1st day of November
2010, and before the sale by the Borrower, Grantor,
any Guarantor, or the holder of any recorded junior
lien or encumbrance paying the entire principal and
interest secured by the Deed of Trust, plus costs,
fees, and advances, if any, made pursuant to the
terms of the obligation and/or Deed of Trust, and
curing all other defaults. Vl. A written notice of de-
fault was transmitted by the Beneficiary or Trustee
to the Borrower and Grantor at the following ad-

property described in paragraph I above, and the
Trustee has possession of proof of such posting.
VII. The Trustee whose name and address are set
forth below will provide in writing to anyone re-
questing it, a statement of all costs and fees due at
any time prior to the sale. VIII. The effect of the sale
will be to deprive the Grantor and all those who
hold by, through or under the Grantor of all their
interest in the above-described property. IX. Any-
one having any objection to the sale on any
grounds, whatsoever will be afforded an opportu-
nity to be heard as to those objections if they bring
a lawsuit to restrain the sale pursuant to RCW
61.24.130. Failure to bring such a lawsuit may re-
