WHEREAS, the City of Shelton, Washington (hereinafter the "CIt ", now owns, called Y ) maintains and operates its combined water and sanitary sewage disposal system pursuant to the provisions of Ordinance No. 750 passed by the City Commission and approved by the Mayor on September 13, 1966, as amended by Ordinance No. 752 passed by the City Commission and approved by the Mayor on October 18, 1966, which such combined system is in need of certain additions, improvements and extensions in order to provide the City, Its inhabitants and people living in the vicinity thereof with an adequate functioning sewage disposal system, and it is necessary to provide for the financing thereof; NOW, THEREFORE, THE CITY COMMISSION OF THE CITY OF SHELTON, WASHINGTON, DO ORDAIN, as follows: Section 1. The city hereby specifies and adopts the following system or plan for making additions to and betterments and extensions of the existing waterworks utility of the City, including the sanitary sewage disposal system as a part thereof (which such combined systems shall hereinafter be referred to as the "Waterworks Utility of the City"): 1. An 18" diameter force main shall be constructed and installed along U.S. Navy-Burlington Northern Railroad from Shelton Creek southerly to Old Olympic Plywood Plant on Fairmount Avenue. 3. A wastewater treatment plant shall" be constructed and i stalled on land acquired by the City, consisting of a double oxidation ditch plant complete with maintenance and operations building, chlorine contact chamber, digesters and related facilities. 4. A 21'. diameter outfall line shall be constructed and installed from the new treatment lant property line to a point in akland Bay off Eagle Point approximately 45 feet below mean sea level. It is hereby further provided that the above described plans shall be subject to such changes as to details or other changes not affecting the main general plan as may be authorized by the City Commission either prior to or during the actual course of construction. The City shall acquire all property, both real and personal, or any interest therein and all easements, franchises, rights-of-way, licenses and permits to carry out the above described plan of improvements. The life of the foregoing additions, betterments and extensions is hereby declared to be at least forty years. Section 2. The estimated cost as near as may be of the acquisition, construction and installation of the aforesaid system or plan of additions, extensions and betterments is hereby declared to be $4,823,650.00 which shall be met and defrayed from the following sources: Ca) A grant anticipated to be received from the United States of America, Environmental Protection Agency, in the sum of $3,603,040.00; (b) A grant anticipated to be received from the State of Washington, Department of Ecology, In the sum of $720,610.00; and I (c)e From the issuance and s a of approximately $500,000.00 par value of water and sewer revenue bonds. Thegross revenues and benefits to be derived from the operation and maintenanEe of the Waterworks Utility of the City at the rates to be charged for water furnished and sanitary sewage disposal service on the entire Utility will, In the judgment of the City Commission, be more than sufficient, to meet all expenses of operation and maintenance thereof and to permit the setting aside into a special fund out of the gross revenues of the Waterworks Utility of the City of sufficient amounts to meet the debt service requirements of the water and sewer revenue bonds herein authorized to be Issued and of all outstanding "Water and Sewer Revenue Bonds, 1972," heretofore issued. Section 4. The bonds herein authorized to be issued shall be issued in one or more series at such time as the City Commission should deem it advisable, shall bear such designation, shall bear such interest rate or rates, shall be in such denominations and form, shall be payable at such place or places out or such special bond redemption fund as shall hereafter be designated, and shall mature In accordance with such schedule beginning not earlier than one year after date of issuance and ending not later than forty years thereafter, or shall be term bonds, shall have such option of payment prior to maturity, shall guarantee such coverage and collection of rates, shall provide for such additional funds and accounts and shall contain and be subject to such provisions and covenants as shall hereafter be provided by ordinance. The bonds shall be sold at such times and in such manner as the City Commission shall deem to be in the best interest of the City. The bonds shall be payable' solely from the gross revenues received from charges for water furnished and sanitary sewage disposal service. Section 5. The proceeds from the sale of the bonds authorized herein and the anticipated grant money received shall be deposited in the special fund of the City heretofore created and established in the office of the City Treasurer and known as the "Water and Sewer Construction Fund." Pending the sale of the water and sewer revenue bonds herein authorized and the receipt of such grant money, the City may issue Interest bearing warrants drawn upon the "Water and Sewer Construction Fund," to bear interest at such rate as may hereafter be determined and to be redeemed from the proceeds received from the sale of the water and sewer revenue bonds herein authorized to be issued and/or any other money of the City available therefor, including grant money, within such period of time as the City Commission may hereafter determine. Section 6. The action of the City officials in heretofore calling for construction bids and entering into contracts to carry out such project is hereby ratified and confirmed as the duly authorized acts of such officials.
