The deputy said Kerr told him Davidson had lunged at him and that he had fallen and the gun had discharged• Creekpaum stated the deputies had looked where Kerr claimed he had fired the first shot but could find no evidence of a shot having been fired. Creekpaum said Kerr had shown him where no trespassing signs were located and stated they were located near his (Kerr's) property line. Creekpaum stated Kerr told him that all times during the incident both Kerr and Davidson had been on Kerr's property. Following Creekpaum on the stand was Warren Girard, Shelton, who stated he was now retired, but was a licensed gunsmith and took care of repair and service on guns for the sheriff's office, corrections center and the Shelton Police Department. Under cross-examination by Nixon, she stated she knew Davidson was talking about the Nicklaus property and that she had heard Kerr's name mentioned by Davidson although she did not know Kerr. Next to testify was Bill Nelson, who stated he was helping out in the store that morning. He stated he lived nearby. He was not related to the Nelsons who operate the store but helped out there off and on. He stated he had served Davidson coffee when he came in and while he was there Davidson said he had been threatened and might get shot. Both he and Gloria Nelson stated they had been visited later by a man who had a tape recorder who talked to them about the incident. Bill Nelson stated he definitely remembered the man saying he was from the Mason County Prosecutor's Office. Art Nicklaus was the last witness for the prosecution. He stated he had seen Davidson the morning Davidson was killed. He said Davidson came to his office to make certain where the south boundary between the Nicklaus and Kerr property was. Nicklaus said he had given Davidson a map showing how to find the boundary line markers. He.stated Davidson had said he was afraid of Kerr and that his life had been threatened.
