was having with a neighbor over an
excessive amount of noise from the

young people practicing band
music.
She stated while Kerr might
appear calm and collected on the
surface he was not really so.
She also stated she had
warned Kerr about over-exerting.
Under cross-examination by
Deputy Prosecutor Gerry
Alexander, Dr. Frese admitted she
had in an affidavit used in the noise
case stated Kerr's mental stability
was affected.
Creekpaum started off the list
of witnesses for the prosecution
Friday morning, testifying to
going to the scene of the shooting
December 24 and talking with
Kerr about what had happened.
He said Kerr pointed out where
he had first seen Davidson, where
Davidson had a pile of brush he
had picked and where Davidson
ran after Kerr had first called to
him to stop. Creekpaum said Kerr
also told of firing a warning shot
and then following Davidson as he
ran up the trail, halted and came
back down. The deputy said Kerr
told him Davidson had lunged at
him and that he had fallen and
the gun had discharged•
Creekpaum stated the
deputies had looked where Kerr
claimed he had fired the first shot
but could find no evidence of a
shot having been fired.
Creekpaum said Kerr had
shown him where no trespassing
signs were located and stated they
were located near his (Kerr's)
property line. Creekpaum stated
Kerr told him that all times
during the incident both Kerr and
Davidson had been on Kerr's
property.
Following Creekpaum on the
stand was Warren Girard, Shelton,
who stated he was now retired,
but was a licensed gunsmith and
took care of repair and service on
guns for the sheriff's office,
corrections center and the
Shelton Police Department.
Using equipment which he
brought into the court with him
he identified the shotgun pellets
taken from the log as No. 4 shot,
the same size as was used in the
gun Kerr was carrying the day of
the shooting•
Following Girard on the stand
was James Bennett, Olympia, who
operates a brush shed in Shelton.
He testified that on December 23,
1971, a deputy sheriff had
brought some brush to his shed
stating it was to be credited to
Davidson's estate.
He said the brush was
processed and was worth $4.90.

describe a visit he made to the

they met at Heinie's Broiler for

It was announced that a

used by the prosecution in the
trial.
He stated that from where
Kerr told officers he was when he
fell and the gun went off was 10
feet from where Davidson was
standing.
Schoening also stated that by
holding the gun the way Kerr had
described to the deputies, the
angle from the end of the gun
barrel to a person's abdomen
would be 20 degrees from one
spot Kerr pointed out and 30
degrees from another.
Following Schoening to the
stand was Gloria Nelson, who
with her husband, operates the
Deer Creek Grocery. She stated

the morning before his death,
Davidson had come into the store
and had coffee at the lunch
counter. She said Davidson had
said he was fearful of going to the
Nicklaus property where he was
picking brush because he had
been threatened by a man on the
adjoining property earlier. She
said Davidson had stated he had
gotten a map of the property lines
but that he did not think the man
would understand.
Mrs. Nelson said that as he
was leaving, Davidson stated he
probably would not be back
because he would likely get shot.
She stated she had kaaown
Davidson for about 20 years and
that for the past several years
since they had operated the store
he often stopped in twice a day to
have coffee.
Under cross-examination by
Nixon, she stated she knew
Davidson was talking about the
Nicklaus property and that she
had heard Kerr's name mentioned
by Davidson although she did not
know Kerr.
Next to testify was Bill
Nelson, who stated he was helping
out in the store that morning.
He stated he lived nearby. He
was not related to the Nelsons
who operate the store but helped
out there off and on.
He stated he had served
Davidson coffee when he came in
and while he was there Davidson
said he had been threatened and
might get shot.
Both he and Gloria Nelson
stated they had been visited later
by a man who had a tape recorder
who talked to them about the
incident.
Bill Nelson stated he
definitely remembered the man
saying he was from the Mason
County Prosecutor's Office.
Art Nicklaus was the last
witness for the prosecution. He
stated he had seen Davidson the
morning Davidson was killed. He
said Davidson came to his office
to make certain where the south
boundary between the Nicklaus
and Kerr property was. Nicklaus
said he had given Davidson a map
showing how to find the
boundary line markers.
He.stated Davidson had said
he was afraid of Kerr and that his
life had been threatened.

Happy at Hy-Lond
Adolph "Duffy" LaRose is
justly proud of his independent
life style. At 81 he has become
too accustomed to a life of
self-reliance and freedom to
settle for less.., that's one
reason he "can't tell you how
much I appreciate having a
place like the Hy-Lond."
During our visit in his neat
room in the Hy-Lond Inn he
reminisced about his life, which

For awhile he lived with one of
his 8 children . . . "the

it was lonesome, she worked all

him to a nursing home just
