ber 21, 2006. She reportedly told
Detective Brett Rutherford of the
Mason County Sheriffs Office that
she had gone on rides with Foster
in the past but this time he pulled
into a barn off Cloquallum Road,
kissed her on the cheek and tried
to unzip her sweatshirt and then
"make out" with her. She report-
edly said she pushed him away by
kneeing him in the stomach and
walked to a residence on West
Plug Mill Road where she had
been staying. The alleged victim
and Foster are cousins.
Judge Toni Sheldon set bail at
$15,000, noting Foster had two
active warrants at the time of his
arrest and was under the supervi-
sion of the Washington State De-
partment of Corrections. "Even
DOC did not have a good fix on
where defendant was at," she com-
mented.

He had been charged with resi-
dential burglary with domestic-vi-
olence designation, defense coun-
sel Ronald Sergi explained, but on
further review it was a stranger's
house he entered. "He thought
that his ex-wife Laurie Fuller was
inside that house," Sergi added.
In his plea statement Fuller ad-
mitted that on October 30, 2006 he
entered a resilience at 708 North
10th Street in Shelton owned by
Len and Jeannie Williams.
The sentencing range for a gross
misdemeanor is up to 365 days,
Judge Sheldon explained, with the
state recommending a sentence of
credit for time served. She sched-
uled sentencing for June 11.
Erica Richelle Robertson,
18, of 111 North Salish Court,
Shelton, pled guilty to theft in the
first degree, resolving a 2006 case.
In her plea statement she wrote,
"Between September 2 and October
23, 2006 I stole over $1,500 from
Wal-Mart where I was an employ-
ee." According to court documents,
the store had surveillance tapes of
her taking $2,470 from a till on 15
separate dates between September
1 and October 23.
Judge Sheldon said with no
prior felony history the standard
sentencing range is from zero to
90 days, with the state recom-
mending part of the sentence be
converted to community service
hours or served on electronic home
monitoring. She said there is no
community supervision under the
standard sentencing range but ex-
plained Robertson is also eligible
for the first-time offender sentenc-
ing option. This would provide for
a sentence of from zero to 90 days
while adding 24 months of commu-
nity supervision.
Robertson is scheduled for sen-
tencing on June 11.
If Foster posts bail, Sheldon
said, he must provide a street ad-
dress to the jail and the DOC. She
ordered him to have no contact
with the alleged victim and told
him he cannot go to places where
children congregate.
In other cases in superior
court:
Gerald D. Smith, 23, of 17661
North Highway 101, Shelton, also
was arraigned on May 25. He pled

cousin.
Smith was arrested by offi-
cers from the sheriffs office and
Skokomish police department who
were investigating a report from
George Miller of 70 North Potlatch
Drive, who reportedly said he was
assaulted by his cousin on May 16
when Miller confronted Smith on
Reservation Road about taking a
lawn mower. Smith had an alumi-
num baseball bat and reportedly
hit Miller in the head with the bat
several times and also struck him
with the barrel of a bb gun.
Smith is scheduled for an omni-
bus hearing on July 16, a pretrial
hearing on July 30 and trial dur-
ing the jury term beginning Au-

is accused of hitting 18-year-old
Rena Corkum with his truck after
the two of them had an argument
outside his residence on Forest

when they were dating and she
came to his residence and took off
in the truck. She said she returned
when he called her and threatened
to report the truck as stolen.

to knock her to the ground.
Thomas Joseph Page, 40,
of 610 West Euclid Avenue, Shel-
ton, pied not guilty to charges of
assault in the fourth degree and
unlawful possession of a firearm
in the second degree. The alleged
assault was identified as domestic
violence against his daughter.
He was arrested May 11 by Of-
ricer Warren Ohlson of the Shelton
Police Department who said he
was responding to a report to the
Shelton Communications Center
of a disturbance at South Seventh
and West Euclid streets involving a
man choking a child. A 13-year-old
girl, identified in court documents
by the initials "K.D.P.," reportedly
said her dad had grabbed her by
the throat after the two of them
argued about her boyfriend. Page
was denied entry into residence on
Euclid and fled into the woods, ac-
cording to the officer's report.
Page reportedly told Ohlson
he had a loaded .38-caliber pis-
tol in his bedroom. Ohlson said
that Page has convictions in King
County and Shelton Municipal
Court for domestic violence and is
prohibited from owning firearms.
According to the probable-cause
statement, Page was intoxicated
at the time of the incident with his
daughter.

ty Jail litter crew working on West
Cloquallum Road on December
14, 2006. He had been sentenced
in Mason County District Court
to consecutive sentences of 365
days for two convictions for driv-
ing under the influence and was
taken into custody on February
11, 2006.
Court-certified interpreter
Mariana Sparkman translated
the proceedings into Spanish and
English.

17633 North Highway 101, Shel-
ton, also was arraigned on May

pleas to two counts of rape of a
child in the second degree and is
scheduled for an omnibus hearing
on June 11, a pretrial hearing on
June 25 and trial during the jury
term beginning July 3.
St. Aubin is accused of having
sexual intercourse with a 14-year-
old girl between October and De-
cember 2006 when he was residing
with the girl's family in Belfair, ac-
cording to a probable-cause state-
ment by Detective Jack Gardner of
the Mason County Sheriffs Office.
The girl reportedly told the detec-

girl's residence and included inci-
dents of oral sex.
Brian Dale Bertelson, 32,
of 583 Camp Hayden Road, Port
Angeles, pied not guilty to at-
tempted assault in the second

during the jury term beginning
July 31.
He was arrested May 7 by
Detective Harry Heldreth of the
SPD, who said he was investi-
gating a report of a disturbance
at the Fred Meyer store at 301
Wallace Kneeland Boulevard.
Steve E. Smith, one of the alleged
victims, reportedly said the inci-
dent began on Olympic Highway
North where a man in a blue Ford
pickup almost hit Smith's vehicle
twice as it attempted to pass and
then followed Smith when he
pulled into the parking lot.
Smith and his passengers, Matt
C. Sorg and Angle M. Briggs, ran
into the store. The driver of the
Ford, later identified as Bertel-
son, followed them inside the
store, holding an axe above his
head and threatening to use it.
A store employee provided the
license plate number of the Ford
and Bertelson was arrested at
the Lucky Dog Casino on High-
way 101 north of Shelton.

at the Fred Meyer store at 301
Wallace Kneeland Boulevard.
Steve E. Smith, one of the alleged
victims, reportedly said the inci-
dent began on Olympic Highway
North where a man in a blue Ford
pickup almost hit Smith's vehicle
twice as it attempted to pass and
then followed Smith when he
pulled into the parking lot.
Smith and his passengers, Matt
C. Sorg and Angle M. Briggs, ran
into the store. The driver of the
Ford, later identified as Bertel-
son, followed them inside the
store, holding an axe above his
head and threatening to use it.
A store employee provided the
license plate number of the Ford
and Bertelson was arrested at
the Lucky Dog Casino on High-
way 101 north of Shelton.
