Judge Sheldon said with no prior felony history the standard sentencing range is from zero to 90 days, with the state recom- mending part of the sentence be converted to community service hours or served on electronic home monitoring. She said there is no community supervision under the standard sentencing range but ex- plained Robertson is also eligible for the first-time offender sentenc- ing option. This would provide for a sentence of from zero to 90 days while adding 24 months of commu- nity supervision. Robertson is scheduled for sen- tencing on June 11. If Foster posts bail, Sheldon said, he must provide a street ad- dress to the jail and the DOC. Smith had an alumi- num baseball bat and reportedly hit Miller in the head with the bat several times and also struck him with the barrel of a bb gun. Smith is scheduled for an omni- bus hearing on July 16, a pretrial hearing on July 30 and trial dur- ing the jury term beginning Au- gust 14.
