May 21 could be used in trial of
the case of Stephen Powell and
Warren Johnson, charged with
possession of more than 40
grams of marijuana.
Defense att°rneys Michael
Mistier of Gig Harbor, for
Powell, and James Sawyer of
Shelton, for Johnson, had asked
that the evidence be ruled
inadmissible because the search
of the vehicle, in which it was
found was illegal.
The hearing started Thursday
afternoon and was continued
until Tuesday morning when
defense attorneys asked that the
evidence which was sought to be
introduced be brought into court
so it could be viewed during the
hearing.
Deputy Leon Smith, who is
, evidence officer for the Mason
County sheriff's department and
had custody of the evidence, was
not available Thursday afternoon
to bring the evidence into court.
The game agents, Ray Taylor
and William Jarmon Jr., were
called as witnesses by Deputy
Prosecutor Gary Burleson.
They testified that about
4:15 p.m. May 21 they were on
patrol in the Dewatto area and,
while driving down a road, they

violation.
The game agents said the
three persons who were
contacted near a car which was
parked on a side road told them
they were shooting at cans.
Taylor said he went to the
patrol car after obtaining
identification from the three to
check if there were wants or
warrants on them.
He said when he returned to
the patrol car, Jarmon informed
him that he had found two
feathers from what appeared to
be a robin on the front
passenger's side door of the
vehicle.
The game agents said they
questioned the three about
shooting songbirds and they
admitted they had shot a robin
which had been thrown into the
brush.
Jarmon said that while
Taylor was talking to the three
young men, he (Jarmon) looked
into the vehicle through the
open front passenger's door and
observed what he believed to be
marijuana seeds on the seat and
floorboard of the car.
Taylor, the officers said,
asked the young men if there
was any more marijuana and
that, in response, Powell went to
the vehicle and pulled a pie tin
with what appeared to be
marijuana in it from under the
front seat and handed it to the
officers.
The game officers said they
then proceeded to search the car
further, finding what they
believed was additional marijuana
and other items.
identification while in the Air
Force.
Jarmon said he had, prior to
joining the game department,
been an undercover drug agent
and was familiar with marijuana.
Judge Doran said in making
his ruling that the game officers
were performing their duties
when they stopped to investigate
after seeing the person with a
rifle and, after discovering
evidence a bird had been shot,
the further investigation was
justified.
Deck on house
questioned
The Mason County Planning
Office has notified Dagne
Johnson that a deck which was
built onto a home on Hood
Canal is illegal.
The planning office said if
plans had been approved by the
U.S. Army Corps of Engineers
they would not be required to
remove the deck.
The county commission has
received a copy of a letter from
Johnson to the Corps of
Engineers, asking for a permit.
