Pretrial pleas come rolling in
A young Shelton man cited drugs
and alcohol as factors in an assault
that he admitted to in Mason County
Superior Court last week in one of
eight guilty pleas entered during the
court's pretrial calendar.
Donald F. Hartwell Jr., 18, of
4463 SE Bloomfield Road, Shelton,
pled guilty on Wednesday, July 21, in
Mason County Superior Court to as-
sault in the second degree with a dead-
ly weapon enhancement.
The plea followed negotiations in
which Deputy Prosecutor Reinhold
Schuetz agreed to reduce the charge
against him from assault in the first
degree.
Hartwell was arrested on May 30
and booked into the Mason County Jail
shortly after midnight on June 1. Po-
lice said he got into a shouting match
at 720 West Pine Street, Shelton, and
told Kelly Moran, "I'm going to kill
you," Schuetz told the court. He then
stabbed Moran in the back with a
steak knife, according to a written
statement from the Shelton Police De-
partment.
"I don't remember exactly what hap-
pened because I have a drug and alco-
hol problem and was under the in-
fluence at the time," Hartwell wrote in
the statement that accompanied his
guilty plea. Judge Toni Sheldon or-
dered a presentence investigation and
scheduled sentencing for August 12.
OTHER DEFENDANTS also
changed their pleas to guilty in superi-
or court on July 21. They are:
* David Littleton Sims Jr., 37, of
NE 130 Jolly Roger Lane, Belfair. He
pled guilty to theft in the first degree
in one case and to stalking and viola-
tion of a no-contact order in another.
The guilty pleas were made after de-
fense attorney Charles Lane worked
out an agreement with the state. Depu-
ty Prosecutor Amber Finlay agreed to
recommend to the court that Sims
serve the two sentences at the time
same.
He faces a standard-range sentence
of 0 to 90 days on the theft charge,
which concerned events of March 30. "I
took a boat and trailer without the
owner's knowledge or permission,"
Sims said in a statement that accompa-
nied his guilty plea.
' The other case was filed because he
violated the terms of a no-contact order
connected to allegations of domestic
violence against a woman. "The defen-
dant had started leaving notes for her,
leaving flowers for her," Finlay said.
Judge Sheldon ordered a presen-
tence investigation and scheduled sen-
tencing for September 9.
Jedidiah Conley Carroll, 18, of
5373 West Minard Road, Bremerton.
He pled guilty to burglary in the sec-
ond degree after Deputy Prosecutor
Schuetz agreed to reduce a more seri-
ous charge of residential burglary.
The case concerns a break-in that
occurred on May 24. "I entered a build-
ing without permission and helped to
carry items that did not belong to me
from the building," Carroll said in a
written statement that accompanied
his change of plea.
Schuetz promised to recommend to
the court that he be sentenced to 30
days in jail with 24 days converted to
community service. He said there is no
need for a presentence investigation.
"We're satisfied there's no prior crimi-
nal history," Schuetz said after he told
the court there was no need for a pre-
sentence investigation.
Judge Sheldon said Carroll has lost
his right to own or possess a firearm.
She scheduled sentencing for July 29.
Gene Ray Brown, 21, of Tahuya.
He pled guilty to committing residen-
tial burglary on June 19.
"I entered a boat at the Shelton
Yacht Club that did not belong to me
without permission of the owner. I took
some items that did not belong to me,"
he said in the written statement that
accompanied his guilty plea.
Defense attorney Lane asked that he
be released to his mother's home pend-
ing sentencing on August 26.
"What we have here is a boat that
was dry-docked. He basically went in
there to have a place to sleep," Lane
said. "He is not a threat to the commu-
nity and he does have a place to stay."
Judge Sheldon denied this request,
noting that Brown had six warrants
pending at the time of his arrest. She
lowered the bail amount from $5,000 to
$2,5oo.
Deputy Prosecutor Schuetz prom-
ised to recommend a mid-range sen-
tence. The judge ordered a presentence
investigation.
Harold Arthur Dugan II, 19, of
6425 53rd Avenue Court West, Taco-
ma. He pled guilty to possession of co-
caine and possession of under 40 grams
of marijuana.
He changed his plea after Deputy
Prosecutor Finlay offered to reduce the
charge from possession of drugs with
the intent to deliver. "I was arrested
while driving in my Vehicle. I had some
cocaine and my marijuana in my. vehi-
cle when I was arrested," he said in the
statement that accompanied his guilty
plea.
Judge Sheldon told Dugan he has
lost the right to own or possess a fire-
arm: She ordered a presentence inves-
tigation and scheduled sentencing for
September 9.
Joseph Edward Andrews, 34, of
North 11 Enetai Court, Shelton. He
pled guilty to possession of metham-
phetamine. Deputy Prosecutor Finlay
promised to recommend that Andrews
be given a mid-range sentence and be
given credit for any time served suc-
cessfully in a drug treatment program.
Andrews made an Alford plea of
guilty. That means he maintains his
innocence but thinks the evidence
against him is such that he was likely
to be found guilty of the crime.
He was arrested after a search that
followed his involvement in a one-car
crash. Judge Sheldon scheduled sen-
tencing for August 12. She told An-
drews he has lost his right to own or
possess a firearm.
Steven Eugene Speck, 32, of 751
East Wood Lane, Shelton. He pled
guilty to domestic violence assault in
the fourth degree. The plea followed
negotiations in which Deputy Prosecu-
tor Finlay agreed to reduce the charge
from two counts of assaulting a child in
the third degree. The case concerned
an incident involving his children on
May 28.
"I struck Billy and Ashley out of
fear and anger - mainly fear," Speck
said in the statement that accompa-
nied his guilty plea.
Finlay has promised to recommend
that he be sentenced to 365 days in jail
with all but 30 suspended and serve
this time on electronic home monitor-
ing or in the day reporting program.
Judge Sheldon ordered that he be
evaluated for these programs. She
scheduled sentencing for August 12.
Stephen R. Gorby, 45, of 71 East
Sonja Lane, Shelton. He pled guilty to
malicious mischief in the third degree
in connection with an incident of do-
mestic violence.
This followed negotiations in which
Deputy Prosecutor Finlay reduced the
charge from malicious mischief in the
second degree. The charge concerned
an incident that occurred on May 3. "I
lost my temper and threw and broke
some items in my house," he said in the
statement that accompanied his guilty
plea. ' .....

tencing for August 26.
