residue. The crystal substance in
the small bag field-tested positive
for meth, officers said.
Officers also reportedly found
two personal checks inside Walk-
ing Eagle's wallet, one on the ac-
count of Javier and Karen Cebal-
los and the other on the account of
Maria Cantu. Karen Ceballos re-
ported the theft of her purse from
the Shelton Wal-Mart on July 30
and Cantu told officers her purse
with her checkbook inside was
stolen July 2 from a shopping cart
at the Wal-Mart in Federal Way.

set bail at $5,000 and scheduled

Shelton, was identified in an in-
vestigation of assault in the third
degree, resisting arrest, posses-
sion of marijuana and use of drug
paraphernalia. He said he would
hire an attorney.
He was arrested September I by
officers of the Shelton Police De-
partment who said they respond-
ing to a report of a fight in prog-
ress at the Pine Tree Restaurant
at 102 South First Street. One of
the officers reportedly asked Rick-
ards to wait by a patrol car and sit
down. Officer Brian Dehning said
Rickards said he had done noth-
ing and was leaving and started
to walk away. Rickards allegedly
refused commands to stop and sit
down.
Dehning said the man took an
aggressive stand in front of him
and attempted to get away when
the officer tried to cuff him. Depu-
ty Jeff Rhoades reportedly poked
Rickards in the ribs with his ba-
ton. During the struggle to take
Rickards into custody, the suspect
allegedly kicked Dehning on his
leg below the knee.
Judge Sheldon said the $6,000
bail which Rickards posted would
remain in effect and scheduled ar-
raignment for September 13.
• Dennis Nieolai Lewis, 38,
of 8633 East State Route 3, Shel-
ton, was identified in an investi-
gation of possession of metham-
phetamine, theft in the third de-
gree and two counts of use of drug
paraphernalia.
He was arrested on Septem-
ber 2 by Shelton police officers
who said they were responding to
a report from Ranger Gapinski,
a loss control officer at Shelton
Wal-Mart, who reported detain-
ing Lewis for allegedly making a
phone charge without paying for
it. Gapinski reported finding sus-
pected methamphetamine and a
syringe and a metal smoking de-
vice when he searched Lewis. The
suspect reportedly was in posses-
sion of a substance which field-
tested positive for meth.
Judge Sheldon appointed Jea-
nette Boothe as defense attorney,
set bail at $4,000 and scheduled
arraignment for September 12.
She ordered Lewis to have no con-
tact with Shelton Wal-Mart.
• Jeremy Hardy, 35, of 2361
East Phillips Lake Loop Road,
Shelton, was identified in an in-
vestigation of malicious mischief
in the second degree and two
counts of assault in the fourth
degree. He is suspected of domes-
tic violence in one of the assault
allegations. He said in court he
would reside with his brother at
the Spencer Lake RV Park.
Hardy was arrested September
2 by deputies who said they were
responding to a report of a distur-
bance at 2361 East Phillips Lake
Loop. He had punched his hand
through a front window of the
residence, according to Flora Pal-
mateer and her sister, Frances J.
Bone. He reportedly had been liv-
ing with Palmateer and her twin
daughters for several months.
Palmateer said she and her
sister went shopping and Hardy
was babysitting her daughters.
She said they had an arrange-
ment in which he agreed he
would not drink at the residence.
Hardy reportedly admitted he
had been drinking alcohol and he
and Palmateer argued. He alleg-
edly pushed her in the chest and
she slapped him. A report alleges
Bone attempted to intervene and
he pulled her hair and pushed her
down on the floor.
Judge Sheldon appointed Sergi
as defense attorney, set bail at
$5,000 and scheduled arraignment
for September 14. She ordered
Hardy to have no contact with
Palmateer, Bone or the residence
on Phillips Lake Loop Road.
• Daniel Lee Rouse, 44, of
4961 East Rasor Road West, Bel-
fair, was identified in an investi-
gation of unlawful possession of a
stolen firearm in the first degree.
He appeared in court with his at-
torney.
He was arrested on August 31
by deputies responding to a fire-
arms complaint about the area of
Rasor Road and Trails End Drive
from James Willey. Deputies re-
ported hearing "a person racking
a shotgun" as they approached
the residence at 4961 Rasor Road.
Rouse reportedly was found at the
kitchen table with Adam Rood
and a shotgun was sitting on a
stool about three feet from Rouse.
Rouse reportedly has previous
convictions for kidnapping in the
first degree and second-degree as-
sault and cannot own, use or pos-
sess firearms.
Judge Sheldon said the $5,000
bail which had been posted would
remain in effect and scheduled ar-
raignment for September 14.
• Marc N. Osker, 50, of 16440
NE 21st Place, Bellevue, was iden-
tified in an investigation of pos-
session of methamphetamine. He
said he would hire an attorney.
He was detained around 11
p.m. on September 3 by Deputy
Kelly LaFrance for driving un-
der the influence. She reportedly
found him in possession of a sub-
stance which field-tested positive
for meth.
Judge Sheldon released Osker
on his promise to appear for ar-
raignment on September 13.

Deputy Prosecutor Mike Dorcy
said an officer of WestNET, the
West Sound Narcotics Enforcment
Team, had informed him that Cole
has a medical marijuana prescrip-
tion.
He was arrested by officers of
WestNET after a suspected out-
door pot-growing operation was
spotted from 500 feet overhead
in a helicopter by Detective Ni-
cole Menge, a certified marijuana
spotter, who was in a helicopter.
Detectives reportedly found 54
plants and 38 starter plants. A
small, plastic bag was found in-
side the residence that contained
white residue that field-tested
positive for meth, according to a
report by the arresting officers.

not testify; mistrial
declared by Sawyer
A mistrial was declared after
a Mason County Superior Court
jury failed to reach a decision in
the first-degree theft trial of a 46-
year-old Shelton man.
Jeffery Shawn Sutherland was
charged with theft in the first
degree involving a domestic vio-
lence incident with his fiancde, Ila
Webb. The alleged victim did not
testify at the trial which began
August 23.
The first witness was Ben Sande
of Mason County Medic One who
said he had contact with Suther-
land on May 31 as he was going
north on Olympic Highway North
with his 3-year-old daughter. He
said a man and a woman were
standing part way on the roadway
of F Street next to the parking lot
of Renegade Guns.
"TO ME THEY both looked
angry and there was some kind of
dispute going on. The woman was
standing just on the pavement and
he was standing on the gravel. It
just grabbed my attention. I pulled
over to observe and see what was
going on," Sande said.
He said he could not hear what
was being said, but there seemed
to be "a lot of anger. I couldn't hear
what was being said." He said he
was about 40 feet away and "ob-
served her going back and forth
talking with him" and "the situ-
ation really struck me as being
odd."
Sande said he called the Shelton
Communications Center when he
saw Sutherland push Webb on her
shoulders with both hands. "He
grabbed her purse and there was a
tussle back and forth. He ended up
with possession of the purse," he
said. "He walked back to a truck. I
witnessed him throwing the purse
really hard on the ground and the
contents went all over."
Sande continued: "He looked up
and made eye contact. He came
over and started screaming, 'Go
away. You need to leave; there's
no problem here.' He was all red
faced."
HE SAID HE provided a state-
ment to Officer Tasesa Malaya of
the Shelton Police Department
who responded at 12:13 p.m. on
May 31 with Officer Daniel Pat-
