Superior court roundup: Kiesel arrested for as Bail was set at $25,000 for a North Mason man accused of hit- ting a Belfair man with his ve- hicle, sending him over the roof of the car in a parking lot in Bel- fair. John Claude Kiesel, 27, of 60 NE Clearview Drive, Tahuya, was identified on November 7 in Mason County Superior Court in an investigation of assault in the first degree and hit-and-run with injury. He said he would hire an attorney. He was arrested in connection with an incident on September 27 by deputies responding to a report that a vehicle had run over a pedestrian in the park- ing lot at Belfair Center. Several witnesses said they observed the victim, Robert R. Richards get hit by a red Kia and said it was an intentional act, according to the probable-cause statement. Witnesses reportedly said that Kiesel and Richards had some kind of verbal exchange after Kiesel threw a stapler at a vehicle; that Richards was five feet in front of the Kia; and that Kiesel got in and drove the car directly at Richards, striking him with the front of the vehicle and throwing him into the front windshield and over the top of the car. Witnesses reportedly said Kiesel never slowed down or stopped and continued out of the parking lot and onto State Route 3. Richards, who is the owner of Babaloo's, was able to identify Kiesel based on the fact that Kie- sers mother is a bookkeeper with an office in Belfair Center. Rich- ards' injuries included a frac- tured clavicle, several fractured ribs, bruises and contusions. Judge James Sawyer set bail at $25,000 and scheduled ar- raignment for November 19. On Tuesday, November 13: * Christopher J. Hutchins, 19, of 1515 West Railroad Av- enue, Shelton, was identified in an investigation of two counts of assault in the second degree. He was arrested in connection with an incident on October 21 which Robert Thomas reported at about 2:39 a.m. as a possible wound to Andrea M.E. John- son, who sustained an injury to her left eye. Thomas said he and Johnson had been harassed ear- lier by a man in a green vehicle. They were walking in the 1500 block of Olympic Highway North when the same Native American man jumped out of the bushes, pointed a rifle with a laser at them and threatened to shoot them, according to the investi- gating officers. Thomas reportedly said he saw the same green vehicle parked at the side of C Street and saw the man with the rifle get into the vehicle and leave. He said he saw Johnson on the ground. Thomas got the license number of the vehicle and learned it was registered to Hutchins. Officers of the Shelton Police Depart- ment located the green vehicle at 1515 Railroad but did not find Hutchins. After a search warrant was obtained an air rifle with a laser was found inside, according to a report on file with the court clerk. Johnson reportedly said she was yelling and screaming at Hutchins. She said he pulled the trigger three times and then he hit her with the butt of the N o__00_:guilty__ple as'. Teen charged with stealing guns from his grandparents A teenager accused of steal- ing a pistol from his grandpar- ents' residence was arraigned on Friday, November 9, in Mason County Superior Court. Kyle Steven Parker, 19, of 21 East Crow Nest Court, Shel- ton, entered not-guilty pleas to charges of residential burglary and theft of a firearm. He is ac- cused of breaking into his grand- parents' residence, which is lo- cated on East Crow Nest Court, on October 14 and taking a .38- caliber pistol. Parker, who was arrested on October 30, has two prior felony convictions and lost his right to own, use or possess firearms. The case is scheduled for an omnibus hearing on November 19, a pretrial hearing on Decem- ber 17, a trial-readiness hearing on December 21 and trial during the jury term beginning Decem- ber 26. Two defendants in unrelated cases were arraigned on Friday, November 9, and are scheduled for omnibus hearings on Decem- ber 17, pretrial hearings on Jan- uary 14, trial-readiness hearings on January 25 and trials during the jury term beginning January 29. * Kevin Michael Wentz, 32, of 126 Rosemary Street, Shelton, is charged with possession of marijuana with intent to deliver and six counts of unlawful pos- session of a firearm in the second degree. Bradley Damon Kenyon, of 502 Maple Street, was sentenced in Mason County Superior Court to two years and two weeks for assault in the third degree. Kenyon was sentenced four days after he pied guilty on Octo- ber 25 to an amended charge. A jury had been selected for a trial of his case and was waiting to begin hearing testimony. He had been charged with second-degree assault, a "strike" offense under the state's persistent-offender sentencing law which mandates a sentence of life in prison with- out the possibility of parole for persons convicted of three strike offenses. Deputy Prosecutor Reinhold Schuetz said the state agreed to reduce the charge since the as- sault with "a closed fist" consti- tuted third-degree assault with "simple bodily harm" rather than second-degree assault with "seri- ous bodily harm." He also noted a material witness warrant had to be issued to get the victim to court. Schuetz said Kenyon punched April Bunting in the face at 502 Maple Street on July 17. If the case went to trial, the state would have shown X rays of Bunting's fractured facial bones, Schuetz added. With an offender score of five, the sentencing range is from 22 to 29 months, Schuetz reported in recommending a mid-range sentence of 24.5 months. "I'd like to just get this over with and get on with my life," Kenyon said. Judge Toni Sheldon imposed the sentence and said Kenyon would be on nine to 18 months of community custody. Because of prior convic- tions for felony offenses, Wentz has lost his right to own, use or possess firearms. Klein said he discovered a large amount of marijuana and notified Maiava, who responded with a dog. Maiava estimated the total weight at about one pound and reported some of it was individually packaged in clear, plastic sandwich baggies. The suspected marijuana field- tested positive. Maiava also re- ported finding a large amount of cash, $10,000, which the drug detection dog alerted on, indicat- ing marijuana. * Sean Christian Davis, 36, of Shelton, pled not guilty to a charge of felony harassment. He is accused of domestic violence for allegedly threatening to kill Evanidia Echeverria, described in court documents as his live-in girlfriend. Davis was arrested at about 5:20 a.m. on October 28 by Deputy Doug Smith of the Ma- son County Sheriffs Office, who said he was responding to a re- port from a newspaper delivery person that there was a woman dressed in pink with her dog near the intersection of Road- runner and McReavy roads. The deputy reported contacting Ech- everria who reportedly told him she and Davis had been at a Hal- loween party and they both had consumed alcohol. When they arrived at their residence at 5012 East Brockdale Road they argued and she said she left the house with her dog and called her ex-husband for a ride. A potential witness, Linda Arnold, said she saw a young man break the window and ride an orange bicycle away from the car. Officer Mike Fiola noted he had seen Boysen riding an or- ange bike and located him at his residence. A pair of brass knuck- les reportedly was found in one of his pockets. Arnold identified Boysen as the person she saw on the bike. Police recovered three packages of cigarettes.
