Kerr conviction upheld by the appeals court The State Court of Appeals has upheld the conviction of Harry Kerr, Grapeview, on manslaughter in the death of George Davidson, a brush picker, in December, 1971. A Mason County Superior Court jury found Kerr guilty of manslaughter in the death. The conviction was appealed to the Court of Appeals. Kerr had been charged with second degree murder in the case. Kerr's attorney, Clay Nixon, Seattle, based the appeal on four things: that the trial court had made error in denying Kerr the defenses that the killing was excusable or justifiable, that the court instructed the jury on intimidation with a firearm, that the court failed to declare a mistrial upon the belated discovery of a remark made by a juror prior to the empaneling and that the court failed to grant a new trial on the grounds that the jury had reached the point of verdict. Kerr, at the time of the trial, stated that Davidson's death was accidental and that he was looking for a brush poacher, carrying the shotgun which fired the fatal shot. The appeals court rejected all of the grounds for appeal. Kerr has been free on bail since his conviction. Oral examinations for chief civil deputy in the Mason County Sheriff's Office scheduled for Friday morning were cancelled after IWA Local 3-38, which represents the deputy sheriff's union, filed a suit asking for an injunction to prevent the examination from being held. A hearing on the injunction was scheduled in Mason County Superior Court Friday, but was not held after an agreement between the sheriff's office and the attorney for the union that the examination would be rescheduled. Information fded in the suit said the notice of the examination had been posted in the undersheriff's office December 8 and that the union representative had been notified of it December 12. Three persons, all presently employed by the sheriff's department, had signed up to take the test. Ann Rose, who served as chief civil deputy, went on disability retirement earlier this year. The test is to fred a successor to her in that position. A SILLY LILY blooms out of season on Washington Street. Tom Wolf purchased the potted plant as an Easter gift for his wife, Judy, more than three years ago. Utterly confused by its frequent transfer from pot to open soil, the specimen perhaps believes itself to be a poinsettia.
